Right of withdrawal

Phonestar Connect can be ordered by private and business customers. You have the right of withdrawal if you order as a consumer, that is, for purposes that are predominantly outside your trade, business or self-employed profession (Section 13 BGB, German Civil Code). Anyone ordering as a business has no right of withdrawal.

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded.

of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notice of exercising the right of withdrawal before the withdrawal period expires.

If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (with the exception of additional costs resulting from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which we received notice of your withdrawal from this contract. For this reimbursement we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged any fees because of this reimbursement.

If you requested that the services begin during the withdrawal period, you must pay us a reasonable amount corresponding to the proportion of the services already provided up to the time you inform us of the exercise of the right of withdrawal with regard to this contract, compared with the total scope of the services provided for in the contract.

The contract is concluded when you receive our welcome email with your access details, at the latest upon activation (Section 3 of the terms). The withdrawal period begins on that day.

Phonestar Connect is set up and activated when the contract is concluded so that you can make calls immediately — which is usually before the withdrawal period ends. If you withdraw from the contract after that, you pay the pro-rata amount for the service provided up to the withdrawal. The proportion is based on the agreed monthly fee, converted to the days from the start of the service until we receive your withdrawal. Connection charges for calls outside the flat rate that you made before the withdrawal are also payable. If you have already paid more, we will refund the difference. There is no setup fee.

Numbers you brought to Phonestar can be moved to another provider within one month after the withdrawal (Section 59 TKG, German Telecommunications Act). Please bear this in mind before withdrawing so that you do not lose your number.

We deliver an eSIM data package as an activation code for the eSIM (QR code or installation details), that is, as digital content not supplied on a tangible medium. If an eSIM data package is in your cart, by ticking the box at checkout you expressly request that we deliver the activation code before the withdrawal period ends, and you confirm that you are aware that your right of withdrawal thereby expires. This box is required to order an eSIM data package because we deliver the activation code immediately.

With the box ticked at checkout, your right of withdrawal for the data package expires as soon as we have begun performing the contract, that is, with the delivery of the activation code (Section 356 (5) BGB). Until then you can withdraw your order of the data package. We confirm your declaration by email.

If you do not want to tick the box, remove the data package from your cart before ordering. This section does not apply to the plan; for the plan, the note on services starting above applies.
